Clarification for use of the words “Commodity Exchange” in a Company registration

In furtherance of circular 2/2014 dated 11.02.2014 wherein ministry has already clarified on use of word ‘National’, ‘Bank’, ‘Stock Exchange’, ‘Exchange’ in the name of the company. MCA through General circular 26/2014 dated 27th June, 2014 has again come up with clarification on use of the word “Commodity Exchange” wherein it has been clarified that the word “Commodity Exchange” can be allowed only where a “No Objection Certificate” from the Forward Markets Commission (FMC) is furnished by the applicant. All the provisions of the Companies (Incorporation) Rules, 2014 shall be applicable on such incorporation.

 

Also, it has been made clear that a existing company registered before the issue of General circular no 26/2014, with a name containing the word “Commodity Exchange”, a certificate from the FMC shall be required.
